  1. LIMITED WARRANTY

  3. THIS SOFTWARE AND MANUAL ARE PROVIDED FOR 
  4. EVALUATION ONLY, ON AN "AS IS" BASIS.  HENNING 
  5. ASSOCIATES DISCLAIMS ALL WARRANTIES RELATING TO 
  6. THIS SOFTWARE, WHETHER EXPRESSED  OR IMPLIED, 
  7. INCLUDING BUT NOT LIMITED TO ANY IMPLIED 
  8. WARRANTIES OF MERCHANTABILITY OR FITNESS
  9. FOR A PARTICULAR PURPOSE. NEITHER HENNING 
  10. ASSOCIATES NOR ANYONE ELSE WHO HAS BEEN INVOLVED 
  11. IN THE CREATION, PRODUCTION, OR DELIVERY OF THIS 
  12. SOFTWARE SHALL BE LIABLE FOR ANY INDIRECT, 
  13. CONSEQUENTIAL, OR INCIDENTAL DAMAGES ARISING OUT 
  14. OF THE USE OR INABILITY TO USE SUCH SOFTWARE,
  15. EVEN IF HENNING ASSOCIATES HAS BEEN ADVISED OF 
  16. THE POSSIBILITY OF SUCH DAMAGES OR CLAIMS.  THE 
  17. PERSON USING THE SOFTWARE BEARS ALL RISK AS TO 
  18. THE QUALITY AND PERFORMANCE OF THE SOFTWARE.

  20. This agreement shall be governed by the laws of 
  21. the Commonwealth of Virginia and shall inure to 
  22. the benefit of Henning Associates and any 
  23. successors, administrators, heirs and assigns. 
  24. Any action or proceeding brought by either party 
  25. against the other arising out of or related to
  26. this agreement shall be brought only in a STATE 
  27. or FEDERAL COURT of competent jurisdiction 
  28. located in Albemarle County, Virginia. The 
  29. parties hereby consent to in personam 
  30. jurisdiction of said courts.
